Instructions for filing a Request for Determination of Applicability with the Conservation Commission

1. Forms Required
1. Request for Determination of Applicability
2. Dover Assessment Fee Form
3. Dover Wetlands Applicant Certification Form
4. Dover Wetlands Filing Notification Form
2. Procedure for Filing
At the time of filing an applicant must submit the following to the commission*:
1. One original and six copies of the Request for Determination form and plan (if applicable),
2. Signed Dover Assessment From with check,
3. abutters list from the most recent records of the Assessors Office and certified mail return receipt, applicant is responsible for notifying abutters by Certified Mail- return receipt,
4. other forms as listed above.
*One complete copy must be sent to the DEP as instructed on WPA Form 1 (Instructions for filing)
A meeting date will be scheduled.
3. Consideration of the request for determination
1. A site visit will be scheduled either before or after the meeting date.
2. The Commission will issue either a Positive or Negative Determination within 21 days of the filing. (A Positive Determination means a Notice of Intent is required for the project.)

2. Procedure for filing

At the time of filing an applicant must submit the following to the Commission:
1. one original and six copies of Notice of Intent from and plan*- the application and plan shall include all pertinent data as required,
2. signed by Dover Assessment Form with check,
3. signed State Fee Transmittal From with check**
4. abutters list from the most recent records of the Assessors Office and certified mail slips, applicant is responsible for notifying abutters by Certified Mail- return receipt
5. all other forms as specified above.

A hearing date will be scheduled within 21 days.
3. Consideration of the Application
1. During the initial hearing a site visit will be scheduled and the hearing continued.
2. Within 21 days of the close of the hearing the Commission must issue an Order of Conditions.
4. Certificate of Compliance
After completion of all work a Certificate of Compliance must be requested in writing* by the applicant as stipulated in the Order of Conditions (please refer to the Order for specific requirements of your project.)
